Mr. G.E. Ekman (or “Geekman”, as we call him) is a caricature representation of the importance of technology in our firm. We use the latest in Microsoft technology, in addition to a proprietary software application that we have developed over the years. So whether it is downloading status reports directly into our volume clients’ websites or uploading subrogation claims directly into our system, we are able to remain flexible and responsive to the needs of our clients.

Back-ups are performed daily and stored off-site to protect our clients’ valuable data. In case of a catastrophic event, our downtime is minimized by the use of virtualization technology for our servers, which will enable us to quickly restore client data.

LNL was the first and is one of the few Ohio firms certified as a “Climate Challenge Partner” by the American Bar Association/Environmental Protection Agency’s Law Office Climate Challenge. We are sensitive to environmental issues. As that relates to technology, we have designed a scanning program which has allowed many of our practice areas to become paperless. Wherever possible, our incoming documents are scanned and converted to a digital format, and our outgoing documents are generated and stored electronically. We have virtually eliminated all paper faxing. We send all faxes electronically, and all incoming faxes are delivered electroncially directly to the receipient’s desktop, eliminating the need for paper. When printing can’t be avoided, we use high post-consumer content recycled paper.

Historically a Legal Technology Leader

Almost from the beginning, Luper Neidenthal and Logan has been a leader in law firm technology. Our efforts to stay ahead of the technological curve date back to the days of the IBM System 3X and Wang systems which provided some of the original functionality that is commonly found in law firms today. Our continued investment in the evolution of this type of technology afforded us unmatched client service, operational efficiency and decision support. Among the most notable effects on our firm and clients is the fact that we have enjoyed, over the last decade, exceptional integration of key data through a custom developed system now known as TotumWare (see more about this below). The benefits that we realized, and continue to realize, from the TotumWare initiative are profound. They include:

  • Unification of Time, Billing & Accounting Data in one system.

  • Integration of documents, journals, tasks and workflows with client and matter records providing a 360 degree view of our clients and the related work effort.

  • Business Intelligence capabilities allowing us to analyze our practice across what are normally unrelated dimensions, including the correlation of such things as time, realization, profit, costs, client and matter count, type of law, attorney, originator and more.

  • The integration of production law data from such areas as foreclosure, collection and subrogation with our core client system eliminating the need for multiple software systems and redundant data entry.

  • Automation of bi-directional, secure data feeds between us and our partners and clients reducing overhead on all sides and improving data quality.

  • Much more planned for release soon.


The 500 lb. Gorilla: Our Technology Partner

While other firms sought to reduce capital expenses by implementing inexpensive and immature solutions that often were promoted as “free” or “open”, our firm decided that we would base our technology investments on a known and long term winner in the information technology arena. For years we have been an early adopter of Microsoft technologies ensuring that our systems are available, perform well and are easy to maintain and upgrade. The tight integration of Microsoft Office with key server technologies from Microsoft, such as Exchange and SQL Server, has made it possible for us to develop very advanced integration and functionality which is normally only found in much larger enterprise class organizations.

A Commitment to Green Computing & Environment Stewardship Through Better Technology

Luper Neidenthal & Logan received the SWACO award for environmental responsibility in no small part because we recognized early on that technology allows us to provide exceptional client service while operating in a manner consistent with responsibility toward the environment. Our TotumWare initiative allows us to dramatically reduce the amount of paper our firm produces. Some of our practice areas are, in fact, paperless through the development and adoption of document management, scanning and database technologies. In all areas of law we have realized a dramatic reduction in the use of paper and ink, so much so in fact that over the years we have actually reduced the number of printers and copiers we use while maintaining roughly the same staffing level.

Another, more recent yet very significant initiative has been to substantially lower our firm’s carbon footprint through significant reductions in the use of electricity. Our firm was an early adopter of “virtualization” technology. This technology, now in its second generation from Microsoft (known as Hyper V), has allowed us to reduce the number of computer servers lowering the amount of electricity needed to operate our systems and cool them. We are now in the process of our second round of virtualization which will bring even greater reductions in energy consumption while simplifying and standardizing our computer infrastructure.

TotumWare: Our Initiative to integrate, modernize and evolve practice management

Through a strategic relationship with Result Data Consulting, Ltd., a leader in business systems development, business intelligence and data warehousing, our firm has established a joint venture through which we plan to standardize and share our advances in practice management software. TotumWare, which is approaching its seventh release, will provide a state-of-the-art Web 2.0 based practice management system to both large and small law firms and other similar organizations. For a decade our firm, in conjunction with our technology partners, has been developing, evolving, testing and using TotumWare. In the future, other firms will be able to share in the many benefits that we have enjoyed over the years.

TotumWare will offer law firms and other organizations both Web based, hosted and on-premise software solutions for time and billing, accounting, trust management, document management, case management, analytics, tasks and workflows, as well as specialized functionality for foreclosure, collections and other production law areas. TotumWare’s inclusion and integration of such advanced features as document search, document version control, integrated time andbilling, accounting and trust management, advanced matter management, firm marketing and task-workflow management will make it unique. FMLA Leave May Be Used For Investigating The Possibility Of A Serious Illness

A North Carolina court recently ruled that a doctor’s visit to obtain test results to determine whether a serious health condition exists can be covered by the FMLA. In that case, the employee had not been previously incapacitated or sick for at least three consecutive calendar days, as FMLA rules require. Therefore, the employee was told she must take personal time off for her doctor's appointments. Since she had no personal days left, she was further told that she would be fired if she attended to her appointment. She did so and was fired. The Court determined that her doctor’s visit to obtain test results to determine whether a serious health condition may exist is covered by the FMLA. The bottom line: seek legal consultation when determining whether to terminate an employee where there is a potential medical issue. Employers that terminate employees with medical issues typically get little sympathy from juries.

You Can Get a Speeding Ticket Without Being Clocked

In a June 2, 2010 decision, the Supreme Court of Ohio held that a police officer’s unaided visual estimation of a vehicle’s speed is sufficient evidence to support a conviction for speeding without independent verification of the vehicle’s speed if the officer is trained, certified, and experienced in visually estimating vehicle speed.

Bankrupt Condo Owner Cannot be Precluded from Voting

A Bankruptcy Court in Virginia recently held that a condominium board violated the automatic stay when it refused to allow a condominium owner (who was a debtor in Chapter 11) to vote at an owners' meeting due to the debtor's delinquency in paying assessments. The Court held that the refusal to allow the debtor to vote was an act to collect the pre-petition past-due assessments. Condominium owners' associations should be mindful of the Secton 362 automatic stay when acting to collect or when taking any action inconsistent with the owner's rights because of pre-petition delinquencies.
