04.01.08 THE MELICK LAW FIRM, LLC MERGES INTO
LUPER NEIDENTHAL & LOGAN
The Columbus, Ohio law firm of Luper Neidenthal & Logan is pleased to announce
that The Melick Law Firm, LLC will merge into its firm.
The Melick Law Firm had been based in Cleveland and will now consolidate its operations
in the LeVeque Tower offices of Luper Neidenthal and Logan. The Melick Law Firm
consists of Gregory Hall Melick and Heather Logan Melick. The Melick Law Firm is
a well respected firm that specializes in civil litigation. In 2003 Mr. Melick obtained
the highest jury verdict in Ohio state court history (in excess of $200 million).
Mr. Melick’s expertise is widely recognized and he has been quoted on legal matters
in The New York Times, The Akron Legal News, The Akron Beacon Journal, and Cleveland’s
SCENE Magazine. In addition to The Melick Firm contributing to the statewide service
of existing Luper Neidenthal & Logan clients, they will also provide valuable
expertise in other areas of civil litigation such as labor, employment, and tort
litigation cases on a contingent fee basis, and/or with a non-traditional fee structure.
Mr. Melick received his B.A. from the University of Dayton in 1986, and his Juris
Doctor from Temple University in 1989. He has worked for the firms of LaBrum &
Doak in Philadelphia, Pennsylvania and Hahn Loeser & Parks in Cleveland, Ohio.
Heather Melick is a 1994 graduate of Wittenberg University, and she received her
Juris Doctor from Case Western Reserve University in 1997. Heather served four and
one-half years in the United States Air Force Judge Advocate General’s Corps, where
she had extensive trial experience and attained the rank of Major. She then joined
the trial practice group of Arter & Hadden and then Tucker Ellis & West,
where she focused on pharmaceutical and mass tort defense work.
Luper Neidenthal & Logan is currently celebrating its fortieth anniversary.
It is a full service law firm with a wide variety of business and individual clients
with legal matters throughout the State of Ohio. The firm is Central Ohio’s only
affiliate of MERITAS, an international association of more than 170 independent
law firms located in over 60 countries.

Litigation: Sometimes
a client’s litigation needs are best served by avoiding litigation. David Scott
recently represented one of the nation’s largest financial holdings companies in
an effort to recover almost $2,000,000 owing from a builder/developer. By promptly
compiling the relevant pleadings, garnishments, lien documents, and a motion to
appoint a receiver, the client was able to leverage the threat of imminent suit
to negotiate a favorable resolution. Roger Whitaker stepped up to coordinate the
documents memorializing the resolution. Avoiding potentially protracted and costly
litigation may not be the best thing for a law firm’s short-term profitability,
but helping clients fulfill long-term goals is always good business.

Deborah Ecker has been
elected to the Board of the Credit Education Coalition, an undertaking of the
office of the Columbus Chapter 13 Trustee. The mission of the CEC is to foster,
through educational seminars, a regular exchange of information between the
credit community and debtor advocates.

Brigid Heid spoke at the Ohio State Bar Association's Intellectual Property
Seminar on the topic of "Protecting IP in the Employment Relationship." The
seminar was held on March 12, 2008 and was attended by over 50 lawyers from
across Ohio.
03.10.08 Melissa Michalsky
recently settled a Probate case in which she is representing a woman who is the
sole beneficiary of her deceased daughter’s estate. Sadly, the client (who is Chinese
and speaks no English) has been the victim of her own son, who had a power of attorney
and used it to misappropriate the deceased’s benefits from OPERS. He then moved
to Indiana and transferred the funds to his girlfriend. Meanwhile, the attorney
for the fiduciary of the Estate has neglected her duties, failed to file accounts,
and ran up excessive legal fees. On behalf of the client, Ms. Michalsky filed an
objection to the final account and argued that the attorney’s fees were excessive.
As a result, the attorney offered to forego a portion of her fee and the client
has accepted the offer. Ms. Michalsky retained Indiana counsel to pursue the son
and his girlfriend and that matter is also close to being successfully resolved
with a substantial payment to the client, who is very satisfied with our firm’s
representation.
03.05.08 We
are pleased to announce that Fred Luper, Bill Logan and Roger Whitaker have been
selected for inclusion in the 2008 edition of Best Lawyers in America®. Fred and
Bill have been recognized for Bankruptcy & Creditors Rights and Roger for Corporate
Law. Selection to the current edition of Best Lawyers was based on more than two
million detailed peer review evaluations of lawyers by other lawyers.

Michalsky has been appointed as a Special Master to administer foreclosure cases
filed in United States District Court.

Michalsky and Frederick Luper successfully argued a disputed Temporary Restraining
Order motion in United States District Court on behalf of a secured creditor of
a failing health care company. The effect of the TRO is to prevent the loss or transfer
of assets, which were in significant risk of being depleted, pending a final determination
of the merits of the secured party’s claim.
02.08.08 On February 8, Business First prominently featured
a story about the firm's flat fee Telephone Consultation Program for employment
issues spearheaded by Debbie Ecker and Brigid Heid. Besides Debbie and Brigid, one
of our satisfied clients Miller's Textile Service was interviewed for the story.
