  1. Under FMLA, an employee must use any accrued time off during his or her leave.
  2. The twelve month employment qualification for FMLA need not be consecutive months.
  3. An employee must follow the employer’s established procedures for requesting FMLA leave.
  4. An employee who describes an absence as providing psychological comfort and reassurance to a family member with a serious health condition is entitled to FMLA leave.
  5. An employee need not specifically mention or request FMLA leave for the leave to be FMLA qualifying.
